NLRB Victory Restores Union Rights To NBC ‘Content Producers’

In a resounding victory for NABET-CWA members, an NLRB ruling out of Region 2 in New York City orders NBC to reinstate the bargaining rights of “content producers,” a title the network created three years ago to strip union representation from nearly 100 photographers, editors and writers.

“On behalf of our affected members and their families, we are extremely pleased with this outcome,” NABET-CWA President Jim Joyce said. “NBC wasted shameful amounts of money to pay for outside legal counsel and consultants just so that it could take away union-negotiated wages and benefits from its workers, many of whom have been loyal NBC employees and NABET-CWA members for years.”

NBC tried to claim that it was consolidating work and creating new, non-union jobs. But the ruling said testimony at hearings this year in New York, Los Angeles, Chicago and Washington, D.C., made it clear that so-called content producers were doing the same work they’d always done, just with a different title.

“The evidence warrants the conclusion that content producers perform the same basic functions previously performed by bargaining unit employees,” said Elbert Tellem, NLRB acting director for Region 2 (New York).

Because NABET-CWA filed the cases as “unit clarification,” NBC has limited rights of appeal. Procedure allows for a full NLRB hearing but no further appeals in federal court, Joyce said.

The decision affects both NABET members who lost their bargaining rights, as well as new employees hired as content producers. Their rights are expected to be restored without delay, Joyce said, even while NBC pursues an NLRB appeal.

Content producers at NBC and NBC-owned stations in New York, Chicago and Los Angeles are directly affected by the ruling.

The decision comes as NABET and NBC begin the fourth year of negotiations for a new contract. In August, NABET members overwhelmingly rejected an NBC proposal that would have rolled back seniority and benefit provisions, among other concessions.

CWA District 1/IBEW Local 2213 and IBEW New England Regional Committees agreed to have subcommittees to work through some of the major issues. These subcommittee meetings will be conducted “off the record” to try and establish proposals to discuss at the regional table. You bargaining committee will do whatever is necessary to obtain a fair contract. We are trying this approach to try and get movement at the bargaining table.  

Every CWA member in every District across this country must continue to fight Verizon and Corporate Greed. Every member must continue to spread the word that Verizon must not be allowed to lower the standard of living by stripping the benefits of their employees. Middle Income families in America will continue to decline if profitable companies like Verizon put Greed before their employees.  

As your Bargaining Committee continues to meet, your Mobilization Committee will continue to meet and develop plans and actions.

CWA District 1/IBEW Local 2213 and IBEW New England Regional Committees as well as the CWA/IBEW Mid Atlantic Regional Bargaining Committee will be returning to the Rye Town Hilton on Tuesday October 25, 2011. We left bargaining so that every CWA Local Executive Board Member in District 1 could visit every company garage, company building or be in the field to talk to every CWA member to tell them exactly what the latest company proposal would mean to their future. We told our members all the facts. Our Local Executive Board members explained to our members what must be done to fight this Company. Our members told us to shine a light on the Company’s Greed and to continue to fight for a fair contract. Our members told us that they are not willing to give up 50 years of collective bargaining victories to a company that is trying to destroy the middle class while making huge profits.

Our members know the facts – all the facts.

Last Thursday, the stewards in every Local met with the members at every work location and explained to them how we will join forces with the “99% group” and the “Occupy Wall Street Group” to fight this Company.  Our members are joining these groups as CWA and IBEW as well as organized labor across this country  are joining “Occupy Any Street” to fight Corporate Greed and the face of Corporate Greed will be Verizon. Verizon’s top five executives took $258 million over four years.  Verizon paid no federal income taxes in 2009 – 2010 and got a $1.3 billion tax refund. Verizon made $22 billion in profits over the last four years.

Verizon should continue to provide good jobs to help American out of the worst recession since the Great Depression instead of trying to destroy the Middle Class.

Marches and Rallies like we had on Friday are happening every day in more and more cities across this country and more and more Americans are raising their voices and joining the fight on Corporate Greed and making Verizon the face of that Greed.

Every CWA member in every District across this country will fight Verizon and Corporate Greed as they Occupy Any Street in this country to shine the light on Verizon the Poster Child of Corporate Greed in America.

We will be returning to the bargaining table knowing that our membership is 100% in support of this Regional Bargaining Committee and your committee will continue to fight for a fair contract and to stop Verizon from destroying the Middle Class.

On Friday, 2,000 CWA members as well as the Occupy Wall Street group, other unions and community groups marched from 140 West Street past Zuccotti Park to a Verizon Wireless store down on Wall Street. The March stated at 140 West Street with an informational picket line and ended with the Rally on Wall Street.

We want to thank all the CWA Members, Occupy Wall Street and the other Unions for coming to West Street and marching with us. The other CWA Locals that attended were Local 1102, 1103, 1104,1105,1106,1108, and 1109.

Activists Taking “IWon’t” Upgrade Message Nationwide

As bargaining continues, thousands of CWAers and allies are keeping up the pressure on Verizon and Verizon Wireless to bargain a fair contract.

Over the last week, hundreds of activists took the nationwide “iWon’t” campaign to customers outside Verizon Wireless stories, urging them not to upgrade to Apple’s new 4S phone until the company agrees to a fair contract.

Last week, Apple’s flagship Stockton Street store in San Francisco was the place to be for CWAers, IBEW members and other allies who passed out leaflets asking customers to delay their upgrades.

“We know tech lovers are eager to get their hands on the latest offering from Apple,” said CWA District 9 Area Director Libby Sayre. “We’re asking that when they do, they take into account the labor record of the service provider they choose. We gave out hundreds and hundreds of fliers, and walked carrying our banners up and down the long line. We got lots of attention.”

At iWon’t and related Verizon and Verizon Wireless mobilizations across the country, CWA members are being joined by supporters from MoveOn.org, the AFL-CIO, US Action, Jobs with Justice, and other groups. Leafleting was also held outside Verizon Wireless stores in Florida in Boca Raton and Ft. Lauderdale, and at the Georgia Dome in Atlanta, where CWAers hand-billed sports fans attending the Atlanta Falcons game. Sign CWA’s “iWon’t Upgrade” pledge to support a fair contract for members at Verizon and Verizon Wireless.

March Against Verizon Corporate Greed

This Friday evening, Oct. 21, together with Occupy Wall Street, Verizon and Verizon Wireless workers will march to protest Verizon corporate greed. Please join us.

We will assemble at 140 West Street between 4 and 5 p.m., march east on Barclay Street and then down Broadway. We should arrive at Liberty Plaza around 5:30 p.m. and move on towards the Verizon Wireless store at about 6 p.m.

As you probably know, 45,000 Verizon and Verizon Wireless workers have been on the front lines of the struggle against corporate greed. Their battle for a fair contract continues and bargaining is not going well.

Verizon is the 16th largest corporation in America, with one of the largest unionized workforces. In the past four years, Verizon made $22.5 billion in profits and paid its top five executives $258 million, and over the past two years the company reaped a $1.3 billion federal corporate income tax rebate—yet it wants to eliminate pensions, force workers to pay thousands of dollars more for health care, slash sick time and eliminate job security. The company’s bargaining stance is that no working person is entitled to decent wages with health care and retirement security, no matter how profitable the employer.

Occupy Wall Street has focused the world’s attention on the destructive power of corporate greed. Verizon is the poster child for that corporate greed. Together, we are demanding that the American economy start to work for the 99% again, not just make the top 1% even richer. Verizon workers are part of the 99%.

2. Thursday, Oct. 20th Info Picketing and Flyer Distribution at all Locations: Picketing at all locations and flyer distribution. This flyer will show that Verizon workers are the 99% and Verizon is the poster child for corporate greed.  

3. Friday, Oct. 21st March from 140 West Street Against Verizon Corporate Greed: Informational picketing will start at 4:00pm at 140 West St. At 5:15 we will march from 140 West St past Zuccotti Park, and rally near a Wireless Store. Occupy Wall Street will join with Verizon workers.  

4. Friday, Oct. 21st Overnight Support for Occupy Wall Street: A small number of CWA volunteers stay overnight at Zuccotti Park after our march. 

5. Ongoing Verizon Wireless and Apple Store Coverage: All locals cover all stores in their areas for as much time as possible (lunchtime, after work to store close, and Saturday and Sunday, also daytime during the week where it’s possible especially with retiree support). Continue to use the leaflets and banners. The iPhone 4S hit the stores recently and stores will have more traffic than normal through the weekend.

Clearly Verizon’s attack is not just on the middle class, or current employees. They have their sight on ALL of our retired Members. This makes this your fight as well.

If you look at their proposals, their goal is to reduce your standard of living. A company that has seen fit not to give our retirees a raise in over 25 years now wants to charge you for your benefits. and not by a few dollars, they want you to pay THOUSANDS of dollars a year for your medical benefits.

Their current proposal includes increased co-payments, increased out of pocket maximums, increased deductibles, and premiums that would eat a sizable chunk of your pensions. The chart below illustrates what they are proposing.

RETIREE MEDICAL – PRE-MEDICARE

PREMIUMS:

  • They range from $1,280.00 for single to $4,480.00 for family.

DEDUCTIBLES:

  • Increased in-network to $850.00 for single to $2,250.00 for family.
  • Increase out of network to $1,000.00 for single to $3,000.00 for family.

OUT OF POCKET:

  • Maximum increased to $2,000.00 for single to $6,000.00 for family.

CO-PAYS:

  • Increase to $25.00 for specialists, the Medicare co-pay to $10-15.

COVERAGE:

  • Reduce most in-network coverage from 100% to 80%.
  • Reduce most out-of-network coverage from 100% to 60%.
  • Post-Medicare is just as drastic.

Can you afford this? We think not!

We will not accept these proposals! But, we need you to get involved in this fight. We need you to help handbill the wireless stores and the public. We need you to write your elected representatives. We need you to bombard Verizon Executives, who make as much as $55,000.00 a day, with letters and e-mails. We need your voices being heard.
